The legal dispute surrounding Kala Hiran: The Battle for Legacy is set to escalate, with the filmmakers announcing plans to approach the Supreme Court after the Delhi High Court directed them to remove the film’s teaser and other promotional material from public platforms.
The controversy stems from a petition filed by Bollywood actor Salman Khan, who claimed that the movie’s promotional content violates his personality rights by making direct and recognizable references to him.
Delhi High Court Orders Removal of Promotional Content
While hearing the matter, the Delhi High Court instructed the makers to take down the teaser and all related promotional material. The court also ordered the removal of interviews featuring producer Amit Jani that were connected to the film’s promotion.
During the hearing, the bench reportedly observed that an individual’s reputation deserves legal protection and expressed concern over the apparent resemblance between the film’s promotional material and Salman Khan. The court indicated that a detailed written order would be issued later.
Salman Khan Alleges Unauthorized Use of His Identity
According to the actor’s petition, the teaser includes several elements that make him easily identifiable. Salman Khan argued that a character in the promotional video wears a blue bracelet similar to the one he has been known for over the years. Another promotional poster reportedly shows a rifle, which, according to the plea, could create an incorrect impression among the public.
The petition also points out that Salman Khan was acquitted in the Arms Act case linked to the 1998 blackbuck hunting incident, making such portrayals potentially misleading.
Director Says Creative Freedom Must Be Protected
Responding to the High Court’s decision, director Bharat S. Shrinate said the production team respects the judiciary and intends to follow the legal process. However, he maintained that filmmakers also enjoy constitutional protection for freedom of speech and artistic expression.
Shrinate stated that while public figures have the right to safeguard their reputation and personality, creative professionals should also be allowed to tell stories through cinema within the framework of the law.
He confirmed that the filmmakers will seek relief from the Supreme Court, expressing confidence that the matter will receive fair consideration under constitutional principles.
CBFC Certification Process to Continue
Despite the ongoing legal battle, the makers have said they will proceed with submitting Kala Hiran: The Battle for Legacy to the Central Board of Film Certification (CBFC) for certification.
As the case moves toward the Supreme Court, it is expected to raise important questions about the balance between personality rights and freedom of artistic expression. Until any further order is passed, the Delhi High Court’s directive requiring the removal of the teaser and related promotional content remains in force.
